Well what I think he trying to say is that she is not an innocent schoolgirl if she was having sex. Doesn't matter if she was drugged or coerced.

She was having incestuous sex with her sister and 2 guys which is disgusting and makes her less sympathetic to jury.
The SA was probably going to go with some angle that the guy dating her sister wanted her and she shot him down so in a jealous rage he killed her; since she is on video having sex with him that's out the window.
This took a year to arrest and the guys lawyer told him NOT to talk to the police unless he was there so I'm guessing this guy was smart and said nothing to the police and a city jury will not convict.

The prosecution is making a statement that she was "uncomfortable" around him, and this may prove otherwise.

Anything that can cast doubt upon anything stated by the prosecution will help the defense.

You would make a terrible one. Her killer will likely spend the rest of their lives in jail, so the sex tape won't change that. But a defender will at least try to mitigate the punishment against his client. It's what they do.

I know....a born defense attorney; and who woulda thunk it? It's not an everyday occurence you see the right wing/"tough on crime" posters making excuses for murderers of teenagers, even if the perfect excuse is sitting right under their nose. Odd, isn't it?

Convicted!! Michale Johnson (the sister's ex BF) is found guilty of 2nd degree Murder..Give him the max....30 years with no chance of parole. I doubt he'll last that long though.

What did the prosecution suggest was his motive...WHY did he kill her? If he was so smitten by her, wouldn't he want her alive...to pursue her? In other words, why kill the object of your 'love'?????

According to the prosecution's witness, Johnson said that after he raped her he couldn't get her to stop crying, so he strangled her.

..."You won't believe what happened," he said Johnson told him as they stood over Phylicia's body wrapped in a bedsheet.

...He said Johnson called him one day, explaining he had a "serious matter" and giving McCray directions to his apartment. Johnson took him into a bedroom, where McCray said it looked as if there had been a struggle. He said Johnson explained that "the girl had been giving him mixed signals about what direction they were going" and that Johnson forced himself on her.

"After that, she wouldn't stop crying. He couldn't get her to stop crying, so he killed her. He said he choked her," McCray said..."
