When will Bobo weigh in, shouldn't they make landing gear out of nurf balls and sponges? Not sure who should get the Darwin, the idiot himself or the parents.

The family of 16-year-old Delvonte Tisdale says negligence by the city, the airport and the airline caused the teen to fall from a Boeing 737 to his death.

this kind of stupidity and resultant knee jerk reactions to blame everyone and not take responsibility for your actions ranks right up there with people who insist on calling the president bobo...but then again with room temperature IQs, what can you expect....

Blandfood, if you weren't such a name calling... ugh.

On this one I would agree, that poor dead boy made his choice. I might agree the airport was negligent in keeping people from going onto the tarmac and climbing into the wheel well of an airplane. After all, what if he'd been a terrorist with a bomb somehow on his person - or knowledge of how to cause harm to the landing gear.

But... HE'S the one that went up in there and fell to his death and I see no way to hold the airline or airport responsible. Heck, they could counter-sue for slander.

Me calling names is something that was given when Bush was in office, you surely remember that. Not important at this time though.

The airport can only do so much. As a kid there was an old B-25 Mitchell parked at Friendship in the mid and late 60's. Me and a buddy couldn't resist the opportunity to craw under the fence and play in it whenever it struck us to do so. Never got caught nor even close as far as I know. No malicious damage, just playing Sky King till we got bored. Point being a airport has a MUCH larger perimeter then most people realize. 10 miles or better of fence wouldn't be at all uncommon, it can't all be watched all of the time.

No way they can be held liable, wheel wells look large but when that strut retracts it also extends due to a nitrogen preload and the actuator has enough pressure to crush anything even in a slipstream trying to hold it back. That wheelwell fills up in a hurry with little to no room. Needless to say it isn't pressurized either, hypoxia or hypothermia would have done the trick as well. Devonte Darwin.....kinda has a nice ring to it, no?

It seeks damages in excess of $10,000.
It's cheaper to settle this one than pay the lawyers to drag it out.

I put this up with train accidents, what part do you not get when it comes to a gross tonnage rules equation?

Trouble is, we don't know how much more than $10,000 this is. That may just be a legal threshold, but I don't think the actual amount of damages claimed was mentioned.

Still, I find it sad some here seem to be rejoicing in this boy's death. He made a stupid decision and paid for it with his life.

While [Attorney Christopher] Chestnut said it's doubtful that Delvonte ran away because he and his father got along just fine, other relatives tell a different story. His brother, Anthony Tisdale Jr. — who also lives in Baltimore — told Crimesider that his brother hated living in Charlotte.

"My brother just wanted to come home," he said, adding the teen "just couldn't take it there."

I celebrate that he's removed from the gene pool. Stupid doesn't even begin to describe what he did. Now if the buffoons that are even considering suing anyone for HIS crime is beyond belief. They too should be removed because they're no more than a bother to humanity. The airport, airline ect ect did what wrong exactly and why should they be bothered with this nonsense?

If someone were stealing your car and you knocked his tooth out should you be sued for dental work?

By "some" you mean [deleted] Bland Food, right? No one else is rejoicing.

And the airline should counter sue for the equivalent of a one way ticket.

Of course, that charge should be prorated as Tisdale didn't fly the whole distance.

Airline has no legal duty to check wheelwells foir stowaways. Also a little something in civil law, known as assumption of risk is a bar to recovery. Any competent judge will toss this on a preliminary motion to dismiss.

I would hope so which was the sole reason for even starting the thread. The kid was an idiot for doing what he did, the father a total *hole for even trying to get a dime out of it. At what point did he do his final act of stupidity.... perhaps when stopped at the end of the field (my best guess) waiting for clearance because too many people milling around the plane at the terminal...... fuelers, baggage handlers and a member of the crew giving it either a preflight, daily or walk around.
