    Investigators said Dwyer's blood-alcohol content was three times above the legal threshold for being under the influence when his powerboat, The Legislator, collided with another vessel on a Pasadena waterway Aug. 22.

    Dwyer, 54, was charged Thursday by Maryland Natural Resources Police with operating a vessel while under the influence of alcohol, reckless operation of a vessel, negligent operation of a vessel, failure to obtain annual certificate of number and a rules-of-the-road violation.

    If convicted, Dwyer faces a year in jail and up to $1,940 in combined fines.

    Del. Donald H. Dwyer Jr. is facing five charges in connection to an August boat crash that sent him and six other people — including four children — to the hospital. Investigators said Dwyer's blood-alcohol content was three times above the legal threshold for being under the influence when his powerboat, The Legislator, collided with another vessel on a Pasadena waterway Aug. 22.

    Dwyer, 54, was charged Thursday by Maryland Natural Resources Police with operating a vessel while under the influence of alcohol, reckless operation of a vessel, negligent operation of a vessel, failure to obtain annual certificate of number and a rules-of-the-road violation.

    If convicted, Dwyer faces a year in jail and up to $1,940 in combined fines.
    This is the state delegate who said that his only legislative priority in Annapolis was defeating same-sex marriage. Sounds like it hasn't been a good year for the far-right-wing wacko.

    What about Dwyer's male companion that was also in the boat with "Full Throttle"? As pointed out when this accident happened, isn't he in law enforcement?!?!

    The toxicology report had his BAC at .24, not the .20 Dwyer himself reported from his hospital test.

    Because all of the charges are misdemeanors, Dwyer apparently does not face potential removal from the General Assembly.

    Under state law, a lawmaker can be removed if convicted of a felony or a misdemeanor related to conduct in office.

    I have noticed that you have used the term "male companion" a couple of times in reference to Dwyer and his friend.

    Yes. It's because the person in the boat with Don was a male and presumably someone who accompanied him on the day's boating activities. And if that person was a member of law enforcement ~ one would think that he might have noticed that Delegate Don was a bit tipsy and driving in an unsafe manner.

    He needs to step down. Same with any other state delegates and senators convicted of DUI or DWI, and Carl Snowden. Agreed?

    Only if it were possible to charge him with other offenses. The maximum penalties are set by the statute, not altered to the defendant case by case.

    But, he's a politician of the hardly matters in MD party and not even very popular with his own party at that so why would anyone give hin favorable treatment?

    Certainly not the big issue in this accident...but I find it strange that neither boat was registered (according to the article.) It's still just $24.00 for two years!

    Especially Carl Snowden. He was just in the news again this week.

    And Dwyer's BAC is unbelievable! He really is unfit to serve. I really do not understand why the law enforcement officer with him allowed him to operate a boat in that condition.

    I agree. The judgment of the officer is obviously questionable.

    Dwyer releases statement.

    "I ask forgiveness from the citizens who have looked to me to represent them with honor and integrity in the General Assembly," Dwyer said in the statement, his first public comments since a post-accident news conference in August at which he admitted he had been drinking and apologized.

    "I intend to prove my personal, temporary difficulties did not and will not affect my ability to represent my constituents fully and completely with character and trustworthiness in the future," the statement continued.
    He contends the other boat hit him.

    Yea... Sure... Alright... Witnesses said they saw his boat speeding and crashing into the "other boat" that he's now claiming that it hit his boat...
