    Default Labor dispute at Maryland/D.C. strip clubs

    Stephanie “Frenchie” Ashe filed suit against the Mile High Club in Clinton, Md. and its owner alleging that the club classified her as an independent contractor and forced her to pay stage fees to perform in order to avoid paying her a minimum wage and providing benefits.

    “You couldn’t imagine IHOP charging its waitresses money to work there or taking their tips,” said Jimmy Bell, Ashe’s lawyer. “There are some clubs that follow the law and pay their dancers. There are other clubs they don’t follow the law for selfish business reasons and they’re going to have to pay the piper.”

    Most clubs went this way about 15yrs ago or so. Don't know where the idea came from but it took hold really quick.

    Even my own co. now hires Independent Contractors in lieu of just putting people on as Part-Timers. It came out of the Corporate mind set. Not much anyone can do about it, it's perfectly legal.

    This is ridiculou. Of course they are independent contractors, like in most clubs and just like cab drivers.

    Charges against the 20 individuals include racketeering, extortion, visa and marriage fraud, and transporting and harboring illegal immigrants. The accused are alleged to be members of the Gambino and Bonanno organized crime families, according to federal authorities.

    You never know when courts get involved:

    "Ashe is the latest stripper to challenge the industry-wide practice of independent contractors. A Massachusetts trial court ruled in 2009 that such arrangements were illegal. Dancers working at the Spearmint Rhino won a record-$13 million in November for being treated as contractors."

    The Rino in Dallas is fantastic. Can't really speak to the one on Mass.

    There is a club off of North Point and Battle Grove. They have a house directly across the street where all of the Russian girls live and the outside is rigged up with more video cameras and survaliance crap than you can believe.
    If there isn't shady crap going on I will eat my hat.

    Default An enterprising reporter could break some news at Dundalk's strip clubs!

    This is the type of information that the Dundalk leadership needs to know. If something shady is happening it could give a bad name to the honest, hard working strippers that put North Point Blvd. on the map!

    A person who receives a 1099, such as an independent contractor, is not considered a regular employee. According to the IRS instructions on form 1099-MISC, for each person a business pays for services, the business must complete a form 1099-MISC. The form is most widely used to report amounts earned and paid to independent contractors.

    You are not an independent contractor if you perform services that can be controlled by an employer (what will be done and how it will be done). This applies even if you are given freedom of action. What matters is that the employer has the legal right to control the details of how the services are performed.

    If an employer-employee relationship exists (regardless of what the relationship is called), you are not an independent contractor and your earnings are generally not subject to Self-Employment Tax.

    This can be a tricky situation and depending on how the club handles the dancers would be critical. Yes handles the dancers

    Hmmm I wonder if some of it depends on creative control?

    With the Affordable Care Act and other government regulations that cost employers more you expect to see the limits of this pushed even more.

    Funny thing is that if the club or chain has more than fifty employees they will have to provide health care and birth control to the strippers if they work more than 30 hours per week. Can you imagine how much they will be charged by any providor willing to contract with them to provide health care. Hey can you imagine the police walking in and seeing jars of cond0ms sitting around and the manager yes we give the girls condoms its required by law. AHCA law. Lots of fun to follow. By making them employees the probability that the club will actually have 50 employees so get your lap dances while you can.
