According to Howard County Police, Vail was wanted in connection with a home invasion in Mt. Airy on Jan. 8, during which three masked men, one of whom had a shotgun, attempted to force their way into a residence located in the 600 block of Long Corner Road in Mt. Airy.


A Frederick County man wanted in connection with a Jan. 8 home invasion in western Howard County was fatally shot early Thursday morning by members of the Frederick County Sheriff's Office Special Services Team serving a Howard County search warrant, according to a sheriff's office news release.

Daniel Vail, 19, of the 4800 block of Westwind Drive, was shot numerous times after he confronted members of the special services team with a shotgun around 1 a.m. inside his two-bedroom apartment.

So they don't have an arrest warrant for the case they are working. They are bootstrapping on an unrelated warrant form another jurisdiction. This raises the issue of the lawfulness of the arrest tactics. The search warrant was delivered after the incidents occurred.

It says they had a search warrant for his home and were executing it. So, they had legal right to enter and search and can overcome any resistance with reasonable force.

Long Corner Road is a north/south road. It begins at Frederick Road just west of Lisbon in Howard County and ends at Route 108 just east of Damascus in Montgomery County. If you are innocent, don't point a shotgun at a bunch of cops with their weapons drawn....

Try to rationalize all you want, but the fact is this idiot decided to point a weapon at law enforcement. They are within their rights to defend themselves, just as you or I would be within our rights to defend ourselves against the threat of being shot.

18 shots so what? After the first 3 or 4 he did not feel a thing. How many Deputies were shooting? If 3 or 4 that only comes out to about 5 or 6 per Deputy. Considering they probably had semi autos that held 15 in a clip does not seem to be overreacting.
