Holder Begs Court to Stop Document Release on Fast and Furious

"Judicial Watch President Tom Fitton said that Holder’s and Obama’s desire to continually hide these Fast and Furious documents is “ironic” now that they’re so gung-ho on gun control. “It is beyond ironic that the Obama administration has initiated an anti-gun violence push as it seeking to keep secret key documents about its very own Fast and Furious gun walking scandal."

"It’s unclear what’s in the documents Obama asserted privilege over, but the president’s use of the extraordinary power appears weak. There are two types of presidential executive privilege: the presidential communications privilege and the deliberative process privilege. Use of the presidential communications privilege would require that the president himself or his senior-most advisers were involved in the discussions.
Since the president and his cabinet-level officials continually claim they had no knowledge of Operation Fast and Furious until early 2011 when the information became public–and Holder claims he didn’t read the briefing documents he was sent that outlined the scandal and how guns were walking while the operation was ongoing–Obama says he’s using the less powerful deliberative process privilege."

    We have an oxymoron administration.

    Holder exonerated last September:

The public learned about program after authorities linked two guns bought by a suspect in the Fast and Furious operation to the slaying of Border Patrol Agent Brian Terry. His death turned the gun-tracking program into a politically toxic matter.

Holder said he didn’t know about Fast and Furious before Terry was killed on Dec. 14, 2010 in southern Arizona. An 18-month independent investigation by the Justice Department’s inspector general found no evidence to the contrary, according to a report released Wednesday.

    Excellent.

So once they release the documents the findings of their internal investigation will be confirmed.

    What's to fear?

The documents have nothing to do with F&F. They're related to the DOJ's response to F&F after the border patrol agent was killed.

    HUH?

    According to the Plaintiffs:

"The lawsuit seeks the enforcement of open records requests relating to Operation Fast and Furious, as required by law."

They want access to the docs that the President used Executive Privilege to keep classified.

None of those docs have anything to do with events prior to the border patrol officer's murder...

    Because I read:

"Holder asked Obama to invoke executive privilege over documents having to do with "the Department's deliberative process concerning how to respond to congressional and related media inquiries into that operation.""

"Holder asked Obama to invoke executive privilege over documents having to do with "the Department's deliberative process concerning how to respond to congressional and related media inquiries into that operation." In other words, Holder is saying the documents don't deal with the government's actual response to Fast and Furious."

Holder is saying...so show the documents and let it end.

There has to be specific reasons why EP is used. Not just because the President decides to use it.

I haven't seen any evidence to show otherwise.

It has always been clear that Issa's investigation into Holder focused on the political response to Fast & Furious, not the operation itself...

Issa wants to know who authorized the operation and how high the knowledge of this operation went.
