Default Illegal alien gets year in jail for deadly crash

Some excerpts from an article in the 1/18/13 edition of The Capital Gazette:

" An Annapolis man was sentenced to the maximum of a year in county jail Thursday for striking and killing a stranded motorist on Route 50 after drinking more than 10 beers.

Jose Jesus Garcia Salmoran, 31, of Americana Drive, previously pleaded guilty to driving under the influence at the time of the deadly July 24, 2011 crash that killed 20-year-old Jasmine Yvonne Owens of Upper Marlboro.

    - he came to the United States from Mexico when he turned 18.

    - Because of Garcia Salmoran’s immigration status, he would be subject to an immigration detainer if incarcerated...

    - Through a Spanish interpreter...

Garcia Salmoran’s record includes three criminal convictions, one involving alcohol, and eight traffic convictions. What jumped off the page, he said, is the fact that six months after the crash, Garcia Salmoran was again charged and convicted of speeding."

One year in local lock-up? This POS should be in leg irons walking the highways 24/7 cleaning up trash. Then maybe another car could perform the justice our system will not.

What would happen to one of us had we done the same in Mexico?

One year in jail lets him out in time to vote (and vote often) for the politicians who work so hard for him.

I guess the system showed him just how serious we are when it comes to dealing with murdering drunk drivers. Ms. Owens life apparently wasn't worth much.

She asked Mulford to consider a suspended sentence. Because of Garcia Salmoran’s immigration status, he would be subject to an immigration detainer if incarcerated, she said.
This guy is exactly the problem. He has no regard for laws or morality.
We have enough native people that act that way. We don't need to import anymore.

    demo--

That doesn't really answer my question.

Not everyone placed under detainer is “illegal.” Immigration detainers are not limited to unauthorized immigrants. Legal immigrants—including long-term legal permanent residents (LPRs, or green card holders) may also be subject to immigration detainers if ICE determines they may be deportable. Immigration law provides that LPRs and other legal visa holders may be deportable for minor violations and misdemeanors, and non-citizens may even be deported retroactively for past criminal convictions. In other words, an individual arrested for a current traffic violation may be subject to an immigration detainer and may be deported for a prior crime, even when that act was not a deportable offense at the time committed, and even where sentenced time has been served for that offense, Finally, ICE could erroneously issue a detainer for a U.S. citizen if there is an error in its database or if the individual’s name is similar to someone else who is in the database.

And what was going on with this? This is is like a bad movie script.

Moments earlier, Owens had lost control of her Chevrolet Malibu, struck a guardrail and stopped in the right lane. She stepped out of her car and was accessing the damage as Garcia Salmoran approached.

Either it is BS that he needs an interpreter or he never really had to learn English because everywhere you go things are listed in spanish as well as English.

Get used to it folks. There will just be more of this crap since Obama and O'Shameless want and need these criminals to invade our country so they can be their voting block.

Everyone who has been so liberal and touch feely about "immigrants" WILL one day be affected by them. You already are in your taxes but many of you are too "out of it" to realize it. They are our "New Americans"

AMEN! I have a friend who is active in politics. She is Hispanic or Latina or whatever what is deemed politically correct. She is from Texas originially. She speaks FLUENT Spanish and catches them at all kinds of crap. It's hilarious.

And we still have no proof that the defendant was here illegally.
