    Default Obama's "recess appointments" struck down by Federal appeals court

    A federal appeals court said Friday that President Obama over-stepped his authority with a series of recess appointments to the National Labor Relations Board. The case may wind up in the Supreme Court, and determine how far the president can go in appointing people whose nominations would be filibustered in the Senate.

    It's not known whether the Supreme Court will step into this White House-Congress dispute.

    As it stands now, the decision invalidates hundreds of decisions made over the past year by the National Labor Relations Board.

    WASHINGTON – A federal appeals court ruled Friday that President Obama violated the Constitution when he sidestepped the Senate to fill open spots on a labor relations panel, in a major setback for the president.

    The suit had been brought by a local business in Washington state challenging the National Labor Relations Board. Supported by dozens of Senate Republicans, the case argued the president didn't have the power to make three appointments to the NLRB.

    Attorneys for the Obama administration argued that he had the authority because the Senate was in recess.

    But a three-judge panel for the Court of Appeals in the District of Columbia said the appointments were not valid because the Senate was not officially in recess. If the decision stands, it could invalidate hundreds of board decisions.

    "Either the Senate is in session, or it is in the recess. If it has broken for three days within an ongoing session, it is not in 'the Recess,'" the panel said.

    At the time he made those appointments I remember listening to Joseph E. diGenova who said what Obama did was unconstitutional. Interesting.

    Ahmen!! But I fear that the traitor in the Whte HOuse will ingore the Court and just plow aahead with the destruction of America.

"This wasn't an activist decision or legislating from the bench. This was a court holding what the Constitution says - that a President may make a recess appointment only if the vacancy he would fill and the appointment occur during the same intersession recess."

    Three Republican Judges, one appointed by Reagan, one by George H.W.Busb and one by George Bush disagree with a Democratic President elected by the people.

    Lets give the Supreme court a crack at this.

    I have no problem with this because Congress was NOT in recess at the time. The problem is the Senate was slow in confirming the nominations.

    Yea lets. So the 5 members of the SC appointed by Republicans, can affirm the lower court. Watch out what you wish for.

    Yeah, pro forma sessions count. He should have had Biden gather enough Democrats to vote the Senate into recess. Then made the appointments.

    GOP long term planning continues to give them powers far beyond their support from the voters.

    Stack the courts at all levels with as many conservative judges as you can (preferably prepped through the Federalist society) so their influence extends between and GOP control of the Presidency or Congress.

    Continually work to block appointments of mainstream judicial appointments when Democrats are in office and jam courts with conservative justices when you are in power.

    Continually work to block appointments to important boards and commissions including Labor Relations, and the Federal Election Commission. By using appointment control on the FEC, that board has remained at an ideological deadlock for a long time now, meaning all votes come out tied and useless and the corruption of Citizens United rolls on.

    And finally, do everything you can to slash budgets for regulatory agencies and micromanage. Hence the ineffectiveness of the SEC, the IRS, the blockage of Eliz. Warren as head of the Consumer Bureau and the strenuous efforts to place budget control for that agency where Congress could gut it (fortunately unsuccessful.)

    It goes on an on and the public is unfortunately uninformed as to how well it blocks almost any meaningful reforms and action by Congress.

    Congrats to Harry Reid, for allowing the republicans to continue to block the Senate from doing anything. This mess, in a nutshell, encapsulates exactly why filibuster reform was so important, and what a disappointment yesterday's cave-in by Harry Reid was. President Obama made recess appointments to the NLRB Board because republicans will not confirm ANYONE to the board.The NLRB board currently has only one confirmed member - meaning, with this decision, not only is the panel meaningless, but scores of decisions are now invalidated. Seems like a particularly dysfunctional way to run a government. That the decision was made by three republican appointees is only icing on the partisan/dysfunction cake, also known as the least favorite party cake ever.

    1- Their authority is granted by the Constitution not the voters
